  33. Congressional hearings on the Administration's Clipper/Skipjack initiative,
  34. and the FBI's draft Digital Telephony surveillance bill, and their
  35. implications for privacy and First Amendment rights, are to be held
  36. April 27 and May 3, 1994.
  37.  
  38. Sen. Patrick Leahy (D-VT), of the Senate Judiciary's Technology and the Law
  39. Subcommittee, has expressed skepticism of the Clipper encryption scheme,
  40. and has called for hearings to examine the problems of this proposal and its
  41. implementation.  This effort is due in part to all of you who responded to
  42. EFF's grassroots campaign to raise fundamental questions about security and
  43. free speech issues in relation to the White House proposal.
  44.  
  45. The Senate hearing will be held on April 27, 1994, 9:30am EDT, Hart
  46. Building Rm. 216, and should feature testimony from the Digital Security
  47. and Privacy Working Group (a broad coalition of industry and public
  48. interest organizations, headed by EFF), Trusted Information Systems' Steve
  49. Walker, Whitfield Diffie of Sun Microsystems, a representative of the
  50. Justice Dept. (possibly Atty. Gen. Janet Reno), NSA Director Adm. Mike
  51. McConnell, and Ray Kammer of NIST.

  59. Following the Senate Hearings, the House Science, Space and Technology
  60. Subcommittee on Technology, Environment and Aviation will be holding a
  61. hearing to address related civil liberties issues of both the Clipper
  62. scheme and the FBI "Digital Telephony" proposal, which so far remains
  63. unsponsored. The hearing will be chaired by Rep. Tim Valentine (D-NC), and
  64. is scheduled for May 3, 1994, 1pm EDT, Rayburn Building Rm. 2318.  Witnesses
  65. will include Ray Kammer of NIST, NSA's Clint Brooks, representatives from
  66. industry in a panel that will include USTA and TIA, expert witnesses
  67. Dorothy Denning and David Farber, and EFF's Jerry Berman on behalf of
  68. DPSWG.  FBI appears not to be making a showing.

  71. and legislative proposals dealing with electronic survellance, privacy
  72. and security, ...the adequacy of the Computer Security Act in protecting
  73. goverment computer systems", and "the Administration's proposed Digital
  74. Telephony legislation and decision to promulgate a voluntary federal
  75. encryption standard".

  87. $1.5M budget) seeks an experienced fiscal manager with background in
  88. nonprofit administration.

  90. EFF focuses on public policy and public awareness concerning information
  91. infrastructure, application of law, and protection of civil liberties in
  92. online media.  Future projects may address changes in social fabric and the
  93. meaning of community, and commercial, economic, and international issues
  94. related to new digital technologies.

  129. on the cutting edge of civil liberties law and policy in high technology, is

  133. The Membership Director is responsible for the planning, structure and
  134. development of EFF's membership program.  These duties include:  developing
  135. a goal-oriented, strategic membership plan; regularly reporting progress
  136. and results to EFF's Executive Director and board; and developing a program

  138. program operates within budget.

  181. Earlier this year, NTIA issued a Notice of Inquiry and Request for Comment
  182. from the public on "privacy issues relating to private sector use of
  183. telecommunications-related personal information associated
  184. with the National Information Infrastructure."  The comments will have
  185. bearing on an upcoming National Telecommunications and Information
  186. Administration report "which may make recommendations to the Information
  187. Infrastructure Task Force and Congress in the area of telecommunications
  188. and information policy".

  190. Last week, EFF called NTIA asking when their privacy report would be made,
  191. and were told that the scheduling was still somewhat flexible, but that
  192. surprisingly few comments had been received before the March 30 deadline. 
  193. We've worked with NTIA's Carol Mattey to reopen the Request for Comments,
  194. with successful results:

  221. Administration (NTIA) has extended the deadline for filing
  222. comments in its privacy Notice of Inquiry (NOI) to May 23, 1994.

  224.      On February 11, 1994, NTIA published a Notice of Inquiry and
  225. Request for Comments in the Federal Register entitled "Inquiry on
  226. Privacy Issues Relating to Private Sector Use of
  227. Telecommunications-Related Information."  59 FR 6842.

  229.      NTIA has received comments from 30 parties in this
  230. proceeding.  Those comments can be reviewed in NTIA's Openness

  315. There is a New York Assembly bill, AB10035 pending which would provide for
  316. free online access to NY legislative information.  This information is 
  317. already paid for by NY state taxes, yet currently is available
  318. electronically only through an expensive commercial firm.

  321. the attention of the Internet/Usenet community, collected some contact
  322. information and had this to say about this legislation:

  324.  "A bill was just introduced in the NY Assembly to make public information
  325.  freely and timely available, via "the most-accessible and least-cost
  326.  public network" i.e., the Internet. Bill A10035 was referred to the

  357. building, among citizens and in the Assembly, so adding your support is not
  358. a waste of time.

  363. bills dealing with online information have already failed this year, two
  364. in Oklahoma, and one in Maryland, due to lack of public input and support.

  447. of personal privacy.  The Clipper chip, export restrictions, the Digital
  448. Telephony proposal - the arguments are numerous and complex, but the
  449. principles are clear.  Who will decide how much privacy is "enough"?

  452. able to ensure the privacy of their personal communications through any
  453. technological means they choose.  However, the government's current
  454. restrictions on the export of encrytion software have stifled the
  455. development and commercial availability of strong encryption in the U.S. 
  456. Rep. Maria Cantwell has introduced a bill (H.R. 3627) in the House that
  457. would liberalize export controls on software that contains encryption, but
  458. needs vocal support if the bill is to make it out of the committee stage.
